April Laws filed a pre-answer motion to dismiss on a case brought pursuant to the Child Victim’s Act (CPLR §214-g) where Plaintiff alleged that, while under the care of the County, he was sexually assaulted by his foster father. The Westchester County Supreme Court dismissed all claims against the County prior to discovery. Plaintiff filed a motion to reargue, which was unsuccessful, and then withdrew his appeal to the Appellate Division, Second Department.
