April Laws secured summary judgment dismissing all federal claims asserted against the County and numerous individual Sherriff’s Deputies brought pursuant to 42 U.S.C. § 1983, alleging violations of Plaintiffs’ due process and search and seizure rights under the Fourth, Fifth, and Fourteenth Amendments. Plaintiffs also asserted claims of violations of their corollary rights under the New York State Constitution, and pendant state law claims for trespass, negligence, conversion, intentional infliction of emotional distress, and prima facie tort. All claims other than trespass were dismissed and the case was remanded to Supreme Court, Washington County. Plaintiffs filed an appeal to the U.S. Court of Appeals for the Second Circuit, which was withdrawn following resolution of the sole remaining negligence claim.
