Poulos v. County of Warren (2024 U.S. Dist. LEXIS 231227 [NDNY Dec. 20, 2024])

Gregg Johnson secured complete summary judgment dismissing claims of malicious prosecution and denial of right to a fair trial on behalf of the County, the District Attorney and six individual corrections staff. In 2021, Attorney Johnson’s motion to dismiss was initially granted by the U.S. District for the Northern District of New York, but the Second Circuit of Appeals reinstated Plaintiff’s malicious prosecution and fair trial claims, which Attorney Johnson successfully disposed of a second time as a result of a post-discovery summary judgment motion.
