Hillary v. Murray (2024 U.S. App. LEXIS 15969 [2nd Cir. 2023])

The U.S. Court of Appeals for the Second Circuit dismissed the civil appeal in the 2017 civil rights action of Hillary v. Murray. The state court criminal prosecution of the Plaintiff (Hillary) for an unsolved murder promoted two civil rights lawsuits and a two-part HBO special. Attorney Johnson successfully obtained a defense verdict in the 2017 case following a June 2022 jury trial dismissing Plaintiff’s false imprisonment and unlawful seizure claims. That defense verdict was confirmed and became final when the Plaintiff’s appeal was dismissed by the U.S. Court of Appeals in July 2023.  As indicated below, Attorney Johnson also successfully disposed of Plaintiff’s 2012 civil rights lawsuit, which asserted various equal protection claims against the Village and several individual law enforcement professionals. In 2023 the U.S. Court of Appeals affirmed that dismissal, as well.
