“Jane Doe,” v. Taylor, 164 AD3d 469 (2d Dept 2018) affd 2016 NY Misc. LEXIS 4674, 2016 NY Slip Op 32470(U) (NY Sup Ct, Jan 29, 2016)
The New York Appellate Division for the Second Department affirmed an Order dismissing a complaint filed by the mother of an elementary student alleging certain personal injuries. The pre-discovery motion filed by Gregg Johnson and his co-counsel successfully sought dismissal of the action based upon the parent’s failure to timely submit a Notice of Claim or seek leave to file a late Notice of Claim. As a result of that motion, all claims against the BOCES and a building Principal were dismissed in their entirety.
