The federal court of the Northern District of NY granted the County’s post-discovery summary judgment motion dismissing the third amended civil rights complaint of a wheelchair bound inmate who demanded certain accommodations. The Plaintiff in this lawsuit was a paraplegic inmate detained at a County Jail who alleged that his civil rights and statutory rights under the ADA were violated when the County declined his multiple demands for a specialized transport vehicle and inmate clothing. After conclusion of discovery, April Laws and Gregg Johnson filed a motion for complete summary judgment which the court granted based upon Plaintiff’s failure to exhaust administrative remedies while a detainee. Plaintiff has appealed this ruling to the US Court of Appeals (as of 3/15/19).
